Terms & Conditions
These terms govern your use of our website, mobile application, services, and SMS messaging program. Please review them carefully before using any Cesare’s service.

By accessing or using the website, mobile application, services, or SMS messaging program provided by Cesare’s Quality Water Solutions LLC (“Cesare’s,” “Company,” “we,” “our,” or “us”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use our website, application, services, or SMS program.
These Terms supplement, and do not replace, any signed installation, lease, service, or commercial agreement between you and Cesare’s. Where a signed agreement and these Terms address the same subject, the signed agreement controls.
Company Services
Cesare’s Quality Water Solutions provides custom-engineered water treatment systems and related services including water testing and consultation, water filtration system design, installation of water treatment equipment, system maintenance and service, and customer support related to installed equipment.
All systems are designed based on water conditions at the time of testing and consultation. Cesare’s does not guarantee “perfect” water or the elimination of every contaminant; performance depends on water chemistry, flow demand, pressure, upstream treatment, and operational practices.
System Design and Performance
Water treatment systems are engineered using water test results and site conditions available at the time of installation.
Water chemistry may change over time due to factors outside of our control. System performance may vary if water conditions change after installation.
Customers are responsible for notifying Cesare’s if significant changes in water quality occur, including new odors, color changes, taste changes, or new contaminants identified by an independent test.
Warranty Terms
Certain systems may include warranty coverage subject to specific terms set forth in the signed installation agreement, lease agreement, or attached Warranty & Performance Exhibit. Warranty coverage may include manufacturer warranties on equipment components and a workmanship warranty on installation.
Warranty coverage does not apply to:
- Issues caused by changes in water chemistry after installation;
- Misuse, modification, tampering, bypass, or damage to equipment;
- Failure to follow recommended maintenance or replace consumables on schedule;
- External plumbing or electrical issues unrelated to our installation;
- Filters, media, UV lamps, membranes, and other consumables, unless expressly stated in writing;
- Normal wear and tear.
Specific warranty length, coverage, and conditions are documented in your signed agreement and/or Exhibit A (Warranty & Performance Terms).
Installation, Site Access, and Pre-Existing Conditions
Customers must provide safe and reasonable access to the installation location, including adequate lighting, clearance, and an adult present when required.
Cesare’s is not responsible for delays or additional work caused by unsafe working conditions, inaccessible installation areas, existing plumbing or electrical issues, or structural limitations.
Pre-Existing Conditions. Existing plumbing, valves, fittings, drains, electrical outlets, and related components may be old, worn, or corroded. If installation reveals or exposes a pre-existing weakness (for example, a corroded fitting that fails when disturbed), the underlying condition is not deemed caused by Cesare’s. Cesare’s may repair such conditions at the customer’s request for additional cost where within scope.
Additional work may require additional charges if conditions differ from those discussed during consultation. Any scope change requires a written change order signed by both parties; verbal approvals are not binding.
Exclusions. Unless expressly included in writing, Cesare’s does not perform: well drilling; well liner or casing work; septic or drain systems; general plumbing rework beyond the tie-in; electrical panel or wiring work; HVAC; hot water tank or appliance repair; structural or foundation modifications; or hazardous material remediation.
Payments, Fees, and Late Charges
Payment terms are outlined in invoices or signed service agreements. Payments may be accepted through electronic payment providers, financing partners, and other approved payment methods.
Invoices must be paid according to the terms stated on the invoice unless otherwise agreed in writing. Failure to pay according to the agreed terms may result in service delays, suspension of warranty coverage, or cancellation of scheduled work.
Card Processing Fee. Credit and debit card payments may incur a processing fee of up to 3.5%.
Late Charges. Past-due balances may accrue interest at 1.5% per month (18% APR) or the maximum rate permitted by law, whichever is lower, plus reasonable collection costs where permitted.
Special-Order and Custom Items. Deposits on special-order or custom items become non-refundable once Cesare’s places the order, except to the extent Cesare’s receives supplier credit, net of restocking and related fees.
Financing
Customers may choose to use third-party financing providers for system purchases.
Financing approval, terms, and payment schedules are determined by the financing provider and are not controlled by Cesare’s Quality Water Solutions.
Customers are responsible for reviewing the financing provider’s terms before accepting financing.
Service Scheduling
Installation and service appointments are scheduled based on availability.
While we work to meet requested timelines, exact service dates cannot always be guaranteed due to scheduling demands, equipment availability, weather, supplier delays, or other circumstances outside Cesare’s control.
Right to Cancel (3 Business Days)
If your agreement is signed at your home, at a temporary location (such as a show or event), or in connection with a door-to-door sale, Pennsylvania and federal rules may provide a right to cancel within three (3) business days. To cancel, deliver or mail a written cancellation notice to Cesare’s within that period at the address shown in Section 14.
If cancellation occurs within the lawful cancellation period, Cesare’s will refund payments as required by law, less documented costs that are legally permitted and any special-order items that cannot be canceled or returned where allowed by law. If this section does not apply to your sale type, it does not create a cancellation right.
SMS / Text Message Program
Program Name: Cesare’s Quality Water Solutions Customer SMS Program.
Program Description. By opting in, customers may receive SMS (text) messages from Cesare’s Quality Water Solutions related to their account, including but not limited to: appointment reminders, install confirmations, service follow-ups, payment receipts and reminders, filter and maintenance reminders, and review or referral requests after completed service. From time to time, customers may also receive occasional service announcements relevant to their account.
How to Opt In. Customers consent to receive SMS messages by:
- Checking the SMS opt-in checkbox on a Cesare’s website form (e.g., the contact form at customwaterfiltration.com);
- Checking the SMS opt-in checkbox during customer portal registration or account update;
- Verbally consenting during in-person consultation or service, with the consent recorded by a Cesare’s representative; or
- Texting START, SUBSCRIBE, or YES to a Cesare’s SMS number.
All opt-ins are logged with date, timestamp, and source. Customers can review or update their consent at any time by contacting Cesare’s using the information in Section 14.
Message Frequency. Message frequency varies based on account activity and service schedule. Customers typically receive between one (1) and ten (10) messages per month.
Message and Data Rates. Message and data rates may apply. Cesare’s does not charge customers for SMS messages, but the customer’s mobile carrier may charge for sent or received messages depending on the customer’s plan.
How to Opt Out. Reply STOP to any message at any time to opt out. Once you reply STOP, you will receive a single confirmation message and no further SMS messages will be sent unless you opt in again. Standard opt-out keywords also recognized: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

Carrier Disclaimer. Mobile carriers (including but not limited to AT&T, T-Mobile, Verizon, and their resellers) are not liable for delayed or undelivered messages. Cesare’s is not responsible for messages that fail to deliver due to carrier issues, mobile network outages, device settings, or invalid mobile numbers.
Privacy of SMS Data. Mobile phone numbers and SMS opt-in consent are collected and stored by Cesare’s for the purpose of operating this SMS program. Phone numbers and SMS opt-in data are not sold, rented, or shared with third parties for marketing purposes. SMS data may be shared only with subprocessors strictly necessary to deliver messages (e.g., our SMS delivery provider). For full details, see our Privacy Policy.
Eligibility. The SMS program is available to customers in the United States with a valid U.S. mobile phone number. Participants must be at least 18 years old or have permission from a parent or legal guardian.
Changes to the SMS Program. Cesare’s may modify or discontinue the SMS program at any time. Material changes will be posted on this page with an updated effective date. Continued participation after changes are posted constitutes acceptance of the revised program terms.
Limitation of Liability and Disclaimer of Warranties
To the fullest extent permitted by law, services and equipment are provided on an “as is” basis except as expressly warranted in a signed agreement or Warranty & Performance Exhibit. Cesare’s disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, except as required by Pennsylvania law.
To the fullest extent permitted by law, Cesare’s Quality Water Solutions shall not be liable for indirect, incidental, special, consequential, or punitive damages (including business interruption, lost revenue, lost profits, spoiled inventory, or regulatory fines) related to the use of our services, equipment, website, application, or SMS program. Cesare’s liability for direct damages is limited to the value of the services or equipment provided.
This Section 10 does not limit liability for compensatory damages caused by gross negligence or willful misconduct, and does not limit any rights that cannot be lawfully waived under Pennsylvania consumer protection law.
Damage Claim Procedure
Any claim for property damage allegedly caused by Cesare’s must be submitted in writing within seventy-two (72) hours of the alleged event, with photos and supporting documentation if available. Customers must allow Cesare’s a reasonable opportunity to inspect before performing repairs, except for emergency mitigation necessary to prevent further damage.
Website and App Use
Our website and mobile application are provided to support customer communication, service documentation, account access, and water-quality reporting.
Users agree not to misuse, scrape, reverse engineer, or attempt to interfere with the operation of the website or application. Cesare’s reserves the right to suspend access in cases of misuse.
Third-Party Services
Our services may involve third-party providers including payment processors, financing companies, SMS delivery providers, email delivery providers, scheduling tools, and software platforms.
These providers operate independently and have their own terms and privacy policies, which govern your use of their services.
Governing Law, Disputes, and Jury Waiver
These Terms are governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles.
Informal Resolution First. Before filing any formal claim, the parties agree to attempt informal resolution by contacting Cesare’s in writing at the address in Section 16 and providing a reasonable opportunity (at least thirty (30) days) to address the dispute.
Forum. If informal resolution fails, the parties agree that any dispute arising out of or related to these Terms, the website, the application, the SMS program, or services provided shall be resolved in the Court of Common Pleas of Westmoreland County, Pennsylvania, or the United States District Court for the Western District of Pennsylvania, as applicable. The parties consent to personal jurisdiction and venue in those courts.
Jury Waiver. To the fullest extent permitted by law, the parties knowingly and voluntarily waive the right to a trial by jury in any dispute arising out of or related to these Terms.
Nothing in this Section limits any right that cannot lawfully be waived under Pennsylvania consumer protection law.
General Provisions
Entire Agreement. These Terms, together with any signed installation, lease, service, or commercial agreement, constitute the entire understanding between you and Cesare’s with respect to the subject matter herein, and supersede prior or contemporaneous oral or written communications.
Severability. If any provision is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
No Waiver. A failure or delay by Cesare’s in enforcing any right under these Terms does not waive that right.
Assignment. Customers may not assign these Terms without Cesare’s written consent. Cesare’s may assign these Terms in connection with a sale or transfer of its business.
Changes to These Terms. Cesare’s may update these Terms periodically. Updated versions will be posted on our website with the revised effective date. Continued use of our website, services, or SMS program after updates indicates acceptance of the revised Terms.
